1. Jerry E. Hargrove, LC0783 Date of Order (7/20/2001) 

 

Licensee surrendered his license to practice clinical professional counseling to avoid prosecution of violating Md. Code Ann., Health Occ. §17-3A-13(4)(5) and (9). (Confidentiality and boundary violations)

Thomas R. Shipley, LC0541 Date of Order (1/25/2001)  

 

Licensee surrendered his license to avoid charges by the Board for acts committed in violation of MD Code Health Occ. §17-313(6) (Is conviction of or pleads guilty or nolo contendere to a felony or a crime involving moral turpitude)

Charles J. Malinowski, AC0454 Date of Order (10/4/2002)  

 

Counselor was charged with violating HO § 17-313(4), (5) and (9) and COMAR 10.58.03.09C – Sexual Misconduct with a former client.  Counselor’s certification was suspended for a period of two (2) years, and immediately stayed. Placed on probation for (3) years subject to certain terms and conditions.

 

Update:  Probation completed on October 26, 2006.  Mr. Malinowski’s certification is in good standing.

Richard Deptula, LCA257  Date of Order (2/21/2003) 

 

Licensee surrendered his license to avoid charges by the Board for engaging in improper sexual behavior with a client, which is a violation of the Maryland Professional Counselors and Therapists Act, Md Health Occ. Code Ann. §17-313(4), (5), and (9) and COMAR 10.58.03.09A

 

5. Kevin Barwick, LC0255 Date of Order (6/13/02) 

 

Licensee was charged with violating HO § 17-313 (4) and (9) and COMAR 10.58.03.03.B (1) and 10.58.03.06A(5) by engaging in nonconsensual sexual behavior with patient and exploiting professional relationship with patient for personal advantage. Board Order:  Suspended for eighteen 18) month. Suspension may be stayed after twelve 12 months after satisfying certain terms and conditions.    Upon completion of all conditions, licensee placed on probation for a period of two (2) years subject to certain conditions.

 

Update:  Probation completed April 21, 2006.  Mr. Barwick’s license is in good standing.

 

6. Debra Levinson, LCO0049 Date of Order (2/21/03) 

 

Licensee violated H.O.§17-313 (4) and (8)  and COMAR 10.58.03.02A (submitted false statement to collect a fee and misrepresented professional qualifications- licensee suspended for six (6) months and suspension immediately stayed and placed on probation for a period of one (1) year subject to certain conditions. 

 

Update:  Probation completed April 23, 2004.  Ms. Levinson ‘s license is in good standing.

 

7. Clifford Dunning, LC0443 and LCM091  Date of Order (1/15/04) 

 

Licensee violated HO §17-313 (4) and (9) and COMAR 10.58.03.05A(2 (a) and (d) and COMAR 10.58.03.08A(1). Licensee failed to meet substantially the standards of practice adopted by the Board: (1) by engaging in unconventional physical contact with patient and jeopardizing patient’s mental heath interest and welfare and (2) by breaching counselor-patient confidentiality.  Ordered licensee placed on probation for one (1) year subject to certain terms and conditions.

 

Update:  Probation completed February 18, 2005.  Dr. Dunning’s  license is in good standing.

 

8. Pamela Dukes, SC1341 Date of Order (10/8/04) 

 

Alcohol and drug counselor did not submit accurate supporting documentation of meeting the qualification under (HO§ 17-306(c) (2) and COMAR 10.58.01.11) Placed on probation for eighteen (18) months subject to certain terms and conditions.

 

Update:  Probation completed May 19, 2006.  Ms. Dukes’ certification is in good standing.

 

9. Frederick Bruner, Ph.D., LCM011 Date of Order (12/17/04)

 

Licensee surrendered license to avoid charges under HO §17-313(4) (7) and (9) and COMAR 10.58.03.03 and COMAR 10.58.03.05.  (Dual Relationship and Professional Competence.

 

10. Hugh A. Roberts, SC0974 Date of Order (2/25/05) 

 

License revoked based on violating Md Health Occ. Code Ann. 17-313 (4), (5) and (9) and COMAR 10.58.03.09 A (3) and B (1) by engaging in a consensual sexual relationship with patient.  Also, fraudulently obtained a renewal of certification, falsely answered questions on renewal form and practiced counseling without certificate.

 

11. Ronald Stanley, AC0345 Date of Order (4/1/05)

 

Certification revoked based on violating H.O. 17-313 (1) (4) (6) (12) and COMAR 10.58.03.09 A (1) (2) (3) (4) and (5); B (1); E (1) (a) and F (1) (2) (3) (a) (b) (c) (d).   Sexual Misconduct; Pled guilty in Circuit Court for Anne Arundel County to one count of assault; sentenced to 4 years incarceration with all but six months suspended; failed to provide truthful and correct answers to questions on renewal application.

 

12. Stacey Chiveral, SC0674 Date of Consent Order (4/15/05)

 

Counselor violated Code of Ethics COMAR 10.58.03.04; 10.58.03.05 and 10.58.03.09 (1) failed to cooperate with investigative proceedings (2) Dual Relationship with former client and (3) Sexual Behavior with former client. Placed on Probation for one year subject to certain terms and conditions.

 

Update:  Probation completed on September 21, 2007.  Ms. Chiveral’s certification is in good standing

 

13. Cassie Mitchell, SCO285 Date of Order 5/20/05 

 

Counselor charged with having a relationship with former client.  Violated COMAR 10.58.03.09.  Certification Revoked after counselor failed to respond to Board hearing.

 

14. Joseph Strovel, AC0709 Date Consent Order  (11/21/03) 

 

Counselor was charged with submitting deceptive documentation to obtain alcohol and drug license.  Downgraded to lower level certification. Placed on probation for 18 months subject to certain terms and conditions.

 

Update:  Probation completed on June 17, 2005.  Mr. Strovel’s certification is in good standing.

 

15. Dana B. Couch-Davis, Ph.D., LCO 542 Date of Order (5/20/05) 

 

Counselor’s license was suspended in the District of Columbia after he voluntarily surrendered his license.  Counselor was disciplined by the District of Columbia for acts that would be grounds for disciplinary action under HO§ 17-313 (4) (10) and (12) and 10.58.03.03A(1); 10.58.03.04A(3); 10.58.03.05A(2)(a) and 10.58.03.08A(1) and (2).  Licensed Revoked by Board.

 

16.

Law Lawrance Lee Thomas – Date of Order November 15, 2005

 

Denial of alcohol and drug counselor licensure based on the following (1) pled guilty to and was convicted of a crime of moral turpitude, in violation of Md. Health Occ. Code Ann. §17-313(6); (2) failed to cooperate with a lawful Board investigation, in violation of Md. Health Occ. Code Ann. §17-313(4) and (13) and COMAR 10.58.03.04A (13); (3) fails to meet the good moral character requirements for licensure as an alcohol and drug counselor as required by §§ 170302(b), 17-302.3(b)

Edwin Fuller – Date of Order – January 9, 2006

 

Alcohol and Drug Certification was revoked based on the following:  Mr. fuller attempted dual relationships with clients, and engaged in sexual harassment of and sexual misconduct with clients, in violation of Md. Health Occ. Code Ann., Section 17-313(4) and (9), and COMAR 10.58.03.05A(2) and B (1), and COMAR 10.58.03.09A and E.

 

18. Stanley J. Benn, LCPC - Date of Order 10/20/2006

 

Professional Counselor Licensed suspended for three (3) years.  On March 7, 2005, Mr. Benn tendered an Alford plea to and was convicted of the first count of Medicaid fraud in the Circuit Court for Baltimore County.  Mr. Benn was sentenced to three years in prison and ordered to make restitution in the amount of $249, 406 to the Medicaid program.

Amy D. Fintrilis  - Date of Order  - 6/23/2006  

Application for alcohol and drug counselor certification denied based on failure to meet “Good Moral Character” as provided under Md. Health Occ. Code Ann Section 17-302 (a) and (b).  The Applicant was charged by the West Virginia Board of Social Work Examiners with violating its rules and regulations and suspended the license for 3 years.  

The Board of Professional Counselors and Therapists concluded that the applicant’s conduct is in a violation of COMAR 10.58.03.04(B ((2); 10.58.03.05(B)(1)(a) and COMAR 10.58.03.09A and B.

 

20. Gary L. Weinberg, Ph.D., LC1132 - Date of Order - April 20, 2007 

 

Professional Counselor License revoked because counselor entered into a dual relationship with a client; compromised the counseling relationship; subjected client to psychological trauma; damaged client’s interests and welfare; fostered dependency; introduced inappropriate sexual content into the counseling relationship by engaging in inappropriate sexual language, sexual exploitation, sexual harassment, sexual behavior and therapeutic deception.

 

The Board concluded that the counselor violated Md. Health Occ. Code Ann. Section 17-313(4), (7), and (9) and COMAR 10.58.03.02A(5)(1989); COMAR 10.58.03.03.A, B(1),E (1), (2), F (2000); and COMAR 10.58.03.04A(14), B(3), 05(A)(2)(a),(d), B(1)(a), 09A,B(1), E, F(2001)

 

21.

Reginald Webb – Date of Order - September 21, 2007 

Alcohol and Drug Counselor surrendered his certification to avoid charges by the Board for acts committed in violation of MD Code Health Occ. §17-313 (4), (5) and (9) and COMAR 10.58.03.09A(4) and B(1), and 10.58.03B, 10.58.03.04B(3).

 

22.

Gabriel W. Adelanwa, LCPC – Date of Order - June 20, 2008 

License was revoked based on violating Md.Health Occ. Code Ann §17-313(6). Licensee pled guilty in the Circuit Court for Prince Georges County, Maryland, to one count of felony Medicaid fraud, in violation of Md. Crim. L §8-509.  Licensee was sentenced to five (5) years imprisonment and ordered to serve a probationary period of five (5) years and to pay court costs.

James A. Dennis, Sr. – Date of Order - October 17, 2008 

Alcohol and Drug certificate was revoked for two (2) years because counselor entered in a sexual and dual relationship with a patient.  The Board determined he violated H.O. § 17-313(4), (7) and (9) and COMAR 10.58.03.04 A, B (3): 10.58.03.05A (2), B and 10.58.03.09A (2) (4), B(1), F(2)(a).

Thomas Shipley- Date of Order – October 17, 2008

Mr. Shipley’s Petition for Reinstatement of former license number LC0541 was denied, and the Board will not accept any further applications for reinstatement from Mr. Shipley.

25.

James Nicholas Deutsch – Date of Order 12/19/08  

Alcohol and Drug Certificate suspended for one year.  Mr. Deutsch acknowledged under oath that he altered the expiration date on his certificate and practiced alcohol and drug counseling for three years without a valid certificate.  Mr. Deutsch violated §17-313(4), (5) & (12) and §17-401 (1), (2) and (3) and COMAR 10.58.03.03.

Stanley J. Benn - Date of Order  12/23/08

Professional Counselor licensed was revoked for five (5) years.  At a hearing before the Board on December 19, 2008, Mr. Benn admitted to the Board that he (1) failed to comply with the requirements set forth in the Board’s October 20, 2006 Final Decision and Order and (2) that he had misrepresented his licensure status on employment application documents after the Board’s suspension of his LCPC license in 2006.

Francisco X. Cummings – Date of Order 5/15/2009 

Surrendered alcohol and drug counselor license to avoid prosecution of violating Board’s Code of Ethics, Code Md. Regs. (COMAR) 10.58.03.03; 10.58.03.04; 10.58.03.05 and 10.58.03.09.  The Board’s investigation concluded that Mr. Cummings engaged in a sexual and dual relationship with a female client during the course of an established client-counselor relationship and exploited the professional relationship for personal advantage.

Damon L Baker, CSC-AD – Date of Order 10/16/2009 

Alcohol and drug certificate suspended for three (3) months with the suspension immediately stayed, and placed on probation for two (2) years.  Mr. Baker admitted he listed fraudulent continuing education hours in his 2007 Renewal Application. Mr. Baker violated COMAR 10.58.03.04B(2); COMAR 10.58.03.03A(3) and H.O.§§ 17-313(1), (4) and (9).
